Topicality. The understanding of marriage and family changes from year to year in a modern society. The role of marriage changes and cohabitation becomes more popular. In different countries there is a different understanding of cohabitation, but also understanding of civil marriage changes. These tendencies seriously affect on outlook of modern young people.

Several years ago some ideas were impossible and even shameful, but now they became usual and ordinary. In this work I would like to consider the concepts of marriage and cohabitation and to analyze their role in a modern society.

Marriage Marriage (or wedlock) is a social union or legal contract between people that creates kinship. People marry for many reasons, including one or more of the following: legal, social, libidinal, emotional, economic, spiritual, and religious.

Types of marriage Marriage can be recognized by a state, an organization, a religious authority, a tribal group or local community. It is often viewed as a contract. Civil marriage is the legal concept of marriage as a governmental institution irrespective of religious affiliation, in accordance with marriage laws of the jurisdiction.

Cohabitation People may live together for any of a number of reasons. These may include wanting to test compatibility or to establish financial security before marrying. It may also be because they are unable to legally marry, a way to avoid the higher income taxes paid by some two-income married couples (in the United States), negative effects on pension payments (among older people), philosophical opposition to the institution of marriage.

Today, cohabitation is a common pattern among people in the Western world, especially those who desire marriage but whose financial situation temporarily precludes it, or who wish to prepare for what married life will be like before actually getting married, or because they see no benefit or value offered by marriage. More and more couples choose to have long-term relationships without marriage, and cohabit as a permanent arrangement.

Legal status of cohabitation Some places, including the state of California, have laws that recognize cohabiting couples as "domestic partners". Half a century ago, it was illegal in every state for adult lovers to live together without being married. Today, on the other hand, just five states (Mississippi, Virginia, Florida, North Dakota and Michigan) still criminalize cohabitation, although anti-cohabitation laws are generally not enforced.

Law cohabitation 1 ) Living together. 2) The law presumes that husband and wife cohabit, even after a voluntary separation has taken place between them; but where there has been a divorce a mensa et thoro , or a sentence of separation, the presumption then arises that they have obeyed the sentence or decree, and do not live together.

3) A criminal cohabitation will not be presumed by the proof of a single act of criminal intercourse between a man and woman not married. 4) When a woman is proved to cohabit with a man and to assume his name with his consent, he will generally be responsible for her debts as if she had been his wife; this being presumptive evidence of marriage; but this liability will continue only while they live together, unless she is actually his were. 5) In civil actions for criminal conversation with the plaintiff's wife, after the husband and wife have separated, the plaintiff will not in general be entitled to recover.
